What to Expect When Divorcing in Houston
Divorce Residency Requirements
You or your spouse must be a Texas resident for six months and a county resident for 90 days. If you or your spouse is stationed outside of Texas as a member of the military, you may be subject to different residency requirements.
Contested or Uncontested Divorce

Do you and your spouse disagree on issues such as:

Either spouse, as long as they meet the residency requirements, may file an uncontested divorce or ‘no fault’ divorce claiming the marriage is insupportable. You can also file an uncontested divorce if you have lived apart for three years or more.
Texas requires mandatory mediation for divorce cases that involve custodial or visitation issues, except for cases of domestic abuse.
